Clarification of Common Terms and Phrases
 
Active Adult
 
Condev may offer homes for sale in communities designated as Active Adult.  These communities are only available to persons who qualify for such housing under the Fair Housing Act. Pursuant to the Fair Housing Act, housing in these communities is intended for occupancy by at least one person 55 years of age or older per home, although the occupants of a limited number of the homes may be younger. Within this limited number, one member of the household must meet other age requirements that may differ from community to community. For more information on age or other restrictions applicable to a specific Active Adult community, please contact the New Home Specialist indicated for that community.
 
Amenities
 
Information regarding existing and/or proposed amenities for all Condev communities are subject to changes, substitutions and/or deletions without prior notice. Condev makes no representation or guarantee that any community or any amenities therein will be built out as planned. You should not rely on the accuracy of any description or list of amenities in making any decision relative to purchasing a home.
 
Completion Date
 
Unless otherwise noted in your purchase agreement, Condev is required to complete, and does agree to complete, the construction of your home within a period of two (2) years from the Effective Date of your purchase agreement. If construction is delayed by events constituting acts of God, or events causing impossibility of performance or frustration of purpose, the date of completion shall be extended by the delay period. It is expressly intended that your and Condev’s rights and obligations under your purchase agreement be construed in the manner necessary to exempt your purchase agreement and the sale of your home from registration under the Interstate Land Sales Full Disclosure Act, and both you and Condev expressly waive any right or provision of the purchase agreement that would otherwise preclude such exemption.
